Can A Doctor Tell The Cops If You Smoke Pot?

I’m having lasik and another procedure and they both affect to the dryness of the eye; same as pot. So I want to tell him that I smoke pot and ask him if I have to wait until I’m fully recovered, could he tell on me?

definitly not. last time i was at the doctor’s he asked about my drug intake. I tried to be all intellectual and said “well I do enjoy smoking marijuana from time to time” and he just nodded and I saw him just write “pot smoker” down, lol. It is actually against the law for them to tell on you because of doctor-patient confidentiality. They could lose their license for breaking that bond.

i don’t know if he can legally tell or not?? i guess if they cops asked the doctor then he could tell them but he won’t just tell them randomly… in the US, it is not illegal to smoke pot, it’s just illegal to posess, sell, grow it!
it’s always best to be honest with doctors so they can treat you more effectively

  3. divine intervention says:

ABSOLUTELY NOT. Your doc is restricted by HIPAA rules and the confidentiality agreement which you most likely signed. All patient conversations and literature are confidential. Even emails are bound by that rule! It’s good that you are upfront about your drug use. It will ensure a better outcome.

  4. natedogg says:

Well first off Dr patient confidentiality only means Dr.s are not forced to tell on you. However having smoked pot in the past is not a crime. You have to be high or sell it or have it on you to break the law. So even if he did tell on you it doesn’t matter no one would care.

  5. Brown Sugar says:

i wouldn’t tell him. just re-schedule the surgery until you feel more comfortable. and no the dr has to observe patient to dr confidentiality. he cannot tell anyone except your parents if you are under 18 and it is a risk to your immediate health.

  6. matt w says:

no. he cannot. doctor patient confidentiality. and he wouldnt bother telling the cops even if he could, its only pot

  7. iggiboog says:

I know in California they can’t. It’s ALWAYS best to be honest with your Doctor to get the right diagnosis and treatment. Tell the Doctor.
